1. Acceptance of Terms

These Terms of Use are a legal agreement between you and LUX GLOBAL LTD, which trades as Endless Adventure. By using the Endless Adventure service (the Service), you agree that you have read, understood, and accept all of these terms. If you don't agree with them, you are not allowed to use the Service and must stop immediately.

2. Service Description

Endless Adventure is an AI-powered service that creates interactive, personalized stories. You can customize story elements like genres and characters, and your choices affect the plot. The AI generates unique stories with accompanying cover art. The Service uses a credit-based system, with one credit allowing you to access one chapter of a story.

3. User Eligibility and Responsibilities

3.1 Age Requirement

You must be at least 18 years old to create an account and use the Service. By using the Service, you confirm you are 18 or older and have the legal capacity to enter this agreement. The Service is designed for teens and adults (13+) but requires adult supervision for users under 18.

3.2 User Conduct

You are responsible for the following: * Making sure any information you provide to customize stories is appropriate and that you have the right to use it. * Using the Service and the generated stories in a legal and ethical way, for the purpose of creating engaging interactive fiction. * Not inputting or generating illegal, harmful, abusive, offensive, defamatory, or inappropriate content. * Protecting the confidentiality of your account information and credits. * Not trying to decompile, reverse engineer, disrupt, or compromise the security of the Service or its AI models. * Not sharing, selling, or transferring your account or credits.

We have the right to remove content or suspend accounts that violate these terms.

4. Credits and Payment

4.1 Credit System

The Service operates on a credit-based system. Each credit lets you generate one chapter of an interactive story. You can get credits in a few ways: * Daily free credits for registered users. * Bonus credits for sharing the app. * Purchasing credit packs through app stores.

4.2 Credit Usage

Credits are used when you generate a new story chapter. They do not expire and will stay in your account indefinitely. Credits are not transferable or refundable unless required by law.

4.3 Payments

All purchases are processed through either the Apple App Store or Google Play Store and are subject to their specific terms and refund policies.

5. Intellectual Property Rights

5.1 Our Content

Unless noted otherwise, the Service is our proprietary property. This includes all source code, databases, software, website designs, audio, video, and most text and graphics. All trademarks and logos are owned or licensed by us.

5.2 User Inputs

You keep any ownership rights you have in the creative inputs you provide, such as character names or genre selections. By providing these inputs, you grant us a license to use, reproduce, modify, and adapt them solely for the purpose of providing and improving the Service, including training our AI models.

5.3 Generated Stories and Artwork

We give you a limited, non-exclusive license to use the generated stories and cover art for your personal, non-commercial use. You can share stories with family and friends for personal enjoyment and export or keep copies of them. However, you are not allowed to use the content for commercial purposes, widely redistribute it, or claim ownership of the AI-generated components.

6. Content and Moderation

6.1 Content Ratings

The Service has content rating systems to help ensure content is age-appropriate. AI-generated content may sometimes have unexpected elements.

6.2 User Responsibility

You are responsible for reviewing any generated content before sharing it, especially with minors. We recommend parental guidance for users under 18.

6.3 Reporting

7. Disclaimers

The Service is provided as is and as available, and you agree that you use it at your own risk. We disclaim all warranties, express or implied, to the fullest extent permitted by law, including those of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee the accuracy, completeness, or reliability of the AI-generated stories, illustrations, or other content. Since the content is produced algorithmically, it may contain unexpected or imperfect elements. We will not be responsible for any errors, inaccuracies, or interruptions of the Service, nor for any viruses or other harmful code transmitted by third parties. We are also not responsible for any loss or damage from the use of content made available through the Service.

8. Limitation of Liability

To the fullest extent permitted by law, we and our directors, employees, or agents will not be liable for any direct, indirect, or other damages, including lost profit or data, that result from your use of the Service. Our total liability to you for any cause will always be limited to the amount you paid us for the Service during the six-month period before the cause of action arose.

9. Indemnification

You agree to defend and hold us harmless from any loss, damage, liability, or claim from a third party that arises from your use of the Service, your inputs, or your breach of these Terms of Use. This also includes your violation of a third party's rights, such as intellectual property or privacy rights, or any harmful act toward another user.

10. Term and Termination

These Terms of Use remain in effect while you use the Service. We reserve the right to deny or terminate access to the Service, or to delete your account and any content you posted, at any time and for any reason, without notice or liability. If your account is terminated, any unused credits will be forfeited, unless applicable law requires otherwise.

11. Governing Law

These Terms of Use and your use of the Service are governed by the laws of England and Wales.

12. Modifications and Interruptions

We can change, modify, or remove content on the Service at any time without notice. We can also modify or discontinue the entire Service or any part of it at any time. We will not be liable to you or any third party for any modifications, price changes, suspensions, or discontinuations of the Service.

We can't guarantee that the Service will always be available. It may experience hardware, software, or other issues, or require maintenance that causes interruptions, delays, or errors.
